EACC goes after Irungu Kang’ata’s law firm, 24 others

Murang’a Senator Irungu Kang’ata’s law firm Irungu Kang’ata &Co Advocates is among 25 law firms being investigated by the Ethics and Anti Corruption Commission over questionable dealings with Nairobi County Government.

In a letter dated Jan., 21, 2021, the EACC requested Nairobi County secretary to provide specific case files handled by the firms between the years 2013 and 2020.

“The Commission is undertaking investigations at the Nairobi City County in respect of payments of legal fees…To facilitate our investigations, kindly but urgently furnish us with the original documents in respect to the mentioned firms.

The firms are Osundwa and Co. Advocates, Kwanga Mboya and Co. Advocates, E. Oyaro and Co. Advocates, Kithi and Co. Advocates, Wanjiku Maina and Co. Advocates, J.O Magolo and Co. Advocates, Ario and Co. Advocates, Maskam (Asanyo), E.N Omoti and Co. Advocates, Ogeto Ottachi and Co. Advocates, Musyoka Mogaka and Co. Advocates, Masire Mogusu and Co. Advocates, Maanzo and Co. Advocates, Miller and Co. Advocates, Koceyo and Co. Advocates, R.M Wafula and Co. Advocates, Mbaluka and Co. Advocates, Njenga Maina and Co. Advocates, Kandie Murtai and Co. Advocates, Kwanga Mboya and Co. Advocates, Sirma and Co. Advocates, Arati and Co. Advocates, C.M Mitema and Co. Advocates, Munyasia and Co. Advocates, and Ogincho Ogincho and Co. Advocates.

The letter from EACC sent to the County Secretary. Kang’ata’s law firm is one of those under investigation.

But Kang’ata, who has been in a political hailstorm these past few weeks over a leaked letter on the unpopularity of the Building Bridges Initiative (BBI) in Mount Kenya region reads malice.

“Criminal justice systems, including EACC, should not be used to manage politics,” he says. “Persuasion and free expression of thoughts should reign supreme. A messenger, however erroneous information he brings, should never be harassed.”

He had followed up this tweet with another one just hours earlier, quoting the Holy Writ: “The Bible says in James 1.12, blessed is the man who remains steadfast during trial.”

In the said BBI letter, which was addressed to President Uhuru Kenyatta, the assumed political leader of the vote-rich Mount Kenya region, Kang’ata had cautioned him about impending defeat at the referendum.

The latest probe by EACC comes after Nairobi MCAs raised the red flag over payment of millions of shilling to law firms by the County government. In total, the County allegedly paid Ksh795.9 million to law firms, with one receiving Ksh250 million.

A report by the Auditor General for the year 2016/17 revealed that City Hall legal department spent Ksh 592.4 million over the period.
