The Solicitor General Ken Ogeto now wants the gazetting of a bill giving Sh15 billion to the Nairobi Metropolitan Services (NMS) revoked, terming the process unlawful.
According to Ogeto the publication of the Nairobi County Supplementary Appropriation Act (2020) in the Gazette Notice did not follow the laid down legal requirements.
Through a letter addressed to Governor Mike Sonko, Ogeto is now faulting Nairobi County Speaker Beatrice Elachi for acting prematurely by publishing the law before even the Assembly assented to it.
“The Government Printer is accordingly advised to take note of the contents of this legal opinion and remedy the situation by taking the necessary action to revoke the purported publication of the Nairobi City County Supplementary Appropriation Act, 2020,” read part of the letter.
The Supplementary Bill was supposed to allocate the General Mohamed Badi-led NMS Sh15 billion to execute the four key functions transferred from the county government.
Governor Sonko had on April 30 cried foul of the said process, alleging that the Bill was sneaked to the Government Printer, without passing through all the legislative process.
